For our Real Estate practice we represent both the buyers and the sellers of real estate and we assist in transactions involving both commercial and residential real estate. Residential Real Estate: We work with both buyer and seller or with landlord and tenant of residential real estate. We will work with the seller’s real estate agent or if the seller is selling their home as "sale by owner" we will assist them in preparing the necessary documents required to negotiate with potential buyers. For buyers, the purchase of their residence is one of the largest investments that they will make. We will assist the buyers by reviewing the abstract of the property and preparing an opinion as to its title. We will work with the buyer’s lender to close the purchase and close the loan, and if necessary, to acquire title insurance from Iowa Finance Authority.

Commercial Real Estate: We work with both buyer and seller or with landlord and tenant of commercial real estate. Many times with commercial real estate there are auxiliary issues that need to be considered such as the sale of inventory and equipment and the consideration of underground storage tanks or other potential environmental matters.

Landlord and Tenant: We work with both landlords and tenants. We assist landlords in establishing systems such as leases, rent deposit procedures and tenant rules. We assist them in using the court system to remove tenants that fail to comply with their leases with a notice to quit and forcible entry and detainer. Beving, Swanson and Forrest attorneys also assist tenants in enforcement of residency codes and lease contracts and the refund of rental deposits.
